This is an important document, which affects your legal rights and obligations. The following terms and conditions should be considered before purchasing a membership. If you have any questions, please ask our representatives before you sign.
By commencing this membership, you acknowledge and accept the following:
1. Membership details
These memberships may be used to attend:
- Reformer classes
- Mat Pilates (and other fitness classes when available)
- For our Reformer Membership 7 only, 1 Sauna session per week is included
This membership does not include Clinical Reformer classes or other specialised classes that are taken by a physiotherapist.
Each membership allows a maximum attendance of classes per week:
- Reformer Membership 2 (RM2) = 2 classes/week max
- Reformer Membership 3 (RM3) = 3 classes/week max
- Reformer Membership 4 (RM4) = 4 classes/week max
- Reformer Membership 5 (RM5) = 5 classes/week max
- Reformer Membership 7 (RM7) = 7 classes/week max
Within the above-mentioned limit, you may attend a maximum of 2 classes in a single day.
Unused classes expire at the end of each membership period. Unused classes do not accumulate.
Memberships have a minimum term of 4 weeks from commencement.
Your upfront payment will be debited at the time of purchase (or the next Monday) and will continue every week. This payment will continue until such time that you or The Body Refinery cancel your membership or place your membership on suspension.
The Body Refinery may cancel memberships by providing at least two weeks’ notice.
Memberships may only commence on a Monday.
Once you have signed the Membership Agreement, you are eligible to purchase Member Only Single classes in the interim via our Admin Team. Member Only Single classes may only be purchased while you have an active Reformer Membership. Exceptions will be made when: new members are waiting for their membership to commence on the next Monday; members would like to attend classes for part of a week at the start or end of a requested membership suspension.
2. Timetable and Public Holidays
The timetable may be changed without notice (e.g. if an instructor cannot make a class). However, The Body Refinery staff will try to communicate any and all changes to the timetable via the website and/or email with as much notice as possible.
We may change instructors or cancel classes when necessary. In the event a class is cancelled, we will attempt to advise you.
Classes can reach maximum capacity. If a Reformer class you’d like to attend reaches its maximum capacity and cannot be attended, you should attend Reformer (or Mat) classes at other times to use the classes included in your membership before they expire at the end of the membership period.
Reformer Classes are not guaranteed to be offered every day. The Body Refinery will try to offer daily classes at times when there is demand, however, instructor availability and public holidays sometimes make this unachievable.
The Body Refinery is closed on public holidays. A reduced class schedule may be applied over holiday periods. The Body Refinery reserves the right to close the studio on days next to public holidays or as needed, be it for studio refurbishment, repairs or otherwise.
3. Suspensions, Transfers, and Cancellations
Memberships may be suspended at the end of a membership period at no charge, however, there is a limit of 4 suspensions per calendar year. Any suspensions beyond this will incur a $30 administration fee.
Once the initial 4 weeks have elapsed, members may change from one membership (with the final day being a Sunday) to another membership (commencing the next day, being a Monday).
Following a suspension, the membership will resume on the next Monday.
Suspensions must be notified at least 1 week prior to the weekly automatic payment (direct debit). Memberships cannot be suspended retrospectively.
Customers may not transfer their membership under any circumstances or at any time.
Suspensions must be taken in whole weeks.
Once the initial 4 weeks have elapsed, memberships may be cancelled by providing at least one week’s notice.
When a membership is cancelled and the same person commences any new membership within 4 weeks of the cancellation, a $30 administration fee will apply.
4. Freezing a Membership during a weekly membership period
You may not freeze a membership part way through a membership period.
You may suspend your membership in accordance with the clause above.
You may be entitled to purchase Member Only Single classes at appropriate times. As an example, if you’ve suspended your membership for a week because you are away for 4 days, you may be eligible to purchase Member Only Single classes
Members Only Single classes will not be priced at the same rate per class as your membership allows, however, they will be at a cheaper rate than our standard Single class price.
5. Late Cancellations and no-shows
Our cancellation policy for memberships aims to be fair, consistent and transparent for all members. Late cancellations (within 12 hours of the class start time) and No-shows will result in the booked class/es being treated as “attended” to deduct the class/es from the number of classes remaining in your membership for the relevant membership period.
If a member “late cancels” (within 12 hours of the class start time) or “no shows” for a booked class more than 2 times in a week, the Member may be advised that continued occurrences will result in termination of the membership.
6. Class Etiquette
Please arrive early for your class – this is particularly important for your first class, so that the instructor may have time to provide a brief overview of the reformer.
Late arrival to classes can be disruptive to the instructor and other clients.
It’s important to wear appropriate clothing that doesn’t hinder movement, as well as socks (preferably gripper socks).
You may not wear clothes that have zippers or other sharp accessories that could damage the vinyl beds.
It’s important that you bring a towel to your class.
7. Bookings
All classes must be booked via the app or online. Admin team members will not make class bookings for members. Classes can be booked up to 2 months in advance but there are no regular or permanent bookings.
8. Member’s Assumption of Risk
You agree to enter and use all the facilities of The Body Refinery entirely at your own risk. You acknowledge that the activity you are to undertake is strenuous and that by participating in it you are exposed to certain risks. You acknowledge and understand that whilst participating in such an activity: you may be injured and that your personal property may be lost or damaged. Other persons participating in such activity may cause you injury or may damage your property. You may cause damage to other persons or damage their property. The conditions under which the activity is conducted may vary without warning, and/or there may be inadequate facilities for treatment or transport of you if you are injured. By signing this document, you hereby release The Body Refinery, its employees and customers from any claim for personal injury, losses, property losses or death incurred whilst on the Premises or common property (15 Lamington Street, New Farm). You hereby acknowledge that you use the premises and all its facilities at your own risk.
Fitness classes can be fast-paced and are generally not well-suited to clients who require variations in exercises to accommodate injuries, medical conditions or other limitations.
Before commencing our Memberships, you agree that you have read a description of the classes you plan to attend (either provided to you or on The Body Refinery website) and confirm that you have no medical conditions or injuries that would prevent you from safely participating in classes at The Body Refinery.
If you have concerns about medical conditions or injuries or whether certain classes are suitable for you to attend, you will advise The Body Refinery in writing and, if appropriate, will book an Initial Assessment appointment with a physiotherapist at The Body Refinery to determine a suitable exercise program.
In the event you sustain an injury or become affected by any other relevant condition, including pregnancy, you must advise your instructor and The Body Refinery before attending classes.
Our instructors and team members are not medical practitioners. Our directions, advice and assistance should not be taken as a substitute for professional medical advice.
Before participating in any Class, you must consult a trained medical practitioner to confirm your ability to participate in that Class. You acknowledge that you may be required to obtain a medical certificate to participate in a Class.
Instructors or managers reserve the right to refuse a client’s participation in a class due to safety or any other reasons.
The minimum age for attendance of a Reformer class is 16. Attendees under 18 years old are required to have a parent or guardian to complete any agreements on their behalf.
9. Fees are as specified in the MindBody Online contract choice
The Body Refinery may at any time, upon written notice to the customer’s last known email address and 14 days’ notice, increase the weekly or monthly payment amount. A customer may cancel their membership within the 14-day notice period should they not agree with the price change.
10. Credit Card details
Participation in this Membership requires credit card details to be retained securely with MindBody (booking software).
11. Credit/Debit Reporting
The Body Refinery reserves the right to report default payments to debt collection agencies in the event past due payments exceed a period of three months. Debt reporting will only be made after two written notices to the customer’s last known email address have been sent.
12. Dishonour Fee
A dishonour fee of $5 will be charged if a payment is declined.
13. Additional Inclusions
By commencing this membership, you agree to the terms and conditions stated above and in your membership choice on MindBody Online. You understand that failure to comply with the terms and conditions of this agreement may result in the suspension or cancellation of your membership, or in financial penalties. The Body Refinery reserves the right to change or cancel classes, hours of operation and all service costs at any time at its sole discretion, without prior notice to members, except as laid out in this agreement and for the term of this agreement. Membership is based on an entitlement to use the facilities of The Body Refinery, not its actual use. Failure to use the facilities does not release the member from their obligations under this agreement.
